Terms of Service

These Terms of Service ("Terms") govern your use of the KeepCast website atkeepcast.app and the KeepCast desktop application for Windows (together, the "Service"), provided by KeepCast ("we", "us", "our"). By using the Service you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
KeepCast is a local-first screen recorder and video editor for Windows. Its core features run on your own device, and your recordings are stored locally. The website provides information about KeepCast, a waitlist, and a blog.
2. License to use the software
Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable license to install and use the KeepCast App for your personal or internal business purposes. We (and our licensors) retain all rights, title, and interest in the Service, including all intellectual property. You may not sell, sublicense, reverse engineer (except to the extent that restriction is prohibited by law), or remove any proprietary notices from the software.
3. Your content is yours
You retain all rights to the recordings, screenshots, and other content you create withKeepCast ("Your Content"). Because the App is local-first, Your Content stays on your device and we do not access it. You are solely responsible for Your Content and for having the right to record the screens, people, audio, and materials you capture — including obtaining any consent required by the laws that apply to you.
4. Acceptable use
You agree not to use the Service to:
- break any applicable law, or record anyone without a legally required consent;
- infringe others' intellectual property, privacy, or other rights;
- distribute malware, or interfere with or disrupt the Service or its infrastructure;
- attempt to gain unauthorized access to any system, account, or data.
5. Third-party services
The App can optionally connect to third-party services you choose — for example, connecting a Google or Microsoft calendar to auto-record meetings. Your use of those services is governed by their own terms and privacy policies, and you are responsible for complying with them. We are not responsible for third-party services.
6. Paid plans (when available)
Some future features may be offered as paid subscriptions or one-time purchases. When they launch, purchases will be sold and processed by a third-party Merchant of Record, who is the seller of record for those transactions and handles billing, payment, and applicable taxes. Pricing, billing cycles, and refund terms will be presented at the point of purchase and, together with the Merchant of Record's terms, will apply to those transactions. Nothing in these Terms currently obligates you to pay for anything.
7. Availability and changes
We may add, change, suspend, or discontinue parts of the Service at any time. We aim to keep the local App working offline and standalone, but we do not guarantee uninterrupted availability of the website or any online feature.
8. Disclaimer of warranties
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free or that it will meet your requirements. You are responsible for maintaining your own backups of Your Content.
9. Limitation of liability
To the maximum extent permitted by law, KeepCast will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, recordings, profits, or revenue, arising out of or related to your use of the Service. To the maximum extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim, or USD $50.
10. Termination
You may stop using the Service at any time and uninstall the App. We may suspend or terminate your access if you violate these Terms. Sections that by their nature should survive termination (such as ownership, disclaimers, and limitation of liability) will survive.
11. Changes to these Terms
We may update these Terms from time to time. We will update the "Last updated" date above, and for material changes we will provide clearer notice. Your continued use of the Service after a change means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of Bangladesh, without regard to conflict-of-law rules. The courts located in Bangladesh will have jurisdiction over any dispute, unless mandatory law in your country of residence provides otherwise.
